Terms of Service - SEOGraphy

1. Agreement

By creating an account, joining the waitlist, or using SEOGraphy (“the Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you don't agree, don't use the Service.

2. The service

SEOGraphy is an AI-powered content platform that helps you generate, edit, and publish blog posts and related images. The Service includes free SEO tools available without an account.

3. Your account

You must be at least 16 years old to use SEOGraphy.
You're responsible for keeping your credentials secure.
You're responsible for all activity under your account, including content published to connected platforms.
You must provide accurate account information and keep it current.

4. Acceptable use

You agree not to use SEOGraphy to:

Generate or publish illegal, infringing, or deceptive content.
Spam, phish, or distribute malware.
Impersonate any person or entity.
Generate content that violates intellectual property, privacy, or publicity rights.
Reverse engineer, scrape, or attempt to access the Service by any means other than our supported API.
Circumvent plan limits or usage quotas.

We may suspend or terminate accounts that violate these rules.

5. AI-generated content

SEOGraphy uses third-party AI models to generate text and images. You are responsible for reviewing generated content before publishing. We don't guarantee that AI output is accurate, non-infringing, or suitable for a particular purpose, and you accept that AI output may include errors.

As between you and us, you own the content you generate through SEOGraphy, subject to your compliance with these Terms and the underlying AI provider's terms.

6. Subscriptions, billing, and trials

Paid plans are billed in advance on a monthly or annual basis through Stripe.
Subscriptions renew automatically until cancelled. You can cancel anytime from your billing settings; you'll retain access until the end of your paid period.
Lifetime Deal (LTD) purchases are one-time payments. LTD seats are subject to a published cap and are non-transferable. A 14-day refund window applies from the date of purchase.
Taxes are your responsibility unless we're legally required to collect them.
Prices may change. We'll give at least 30 days' notice before any price change affects your plan, and your existing subscription will be honored at the previous price for the current billing period.
Waitlist members who signed up for a 10% forever discount will keep that discount applied to any paid plan as long as their subscription remains continuously active.

7. Free plan

We offer a free tier subject to usage limits. We reserve the right to change or discontinue free features with reasonable notice.

8. Third-party integrations

The Service integrates with WordPress and other platforms via their public APIs. We're not responsible for changes those platforms make that affect integration behavior, nor for downtime or issues caused by them. You're responsible for complying with the terms of any platform you connect.

9. Intellectual property

SEOGraphy, the marketing site, the application, and all related logos, copy, and design are our property or licensed to us. You may not copy or reuse them without permission. All feedback you send us may be used to improve the Service without compensation.

10. Disclaimers

The Service is provided as is and as available, without warranties of any kind. We don't guarantee specific search-engine rankings, traffic, or business outcomes. We don't guarantee that the Service will be uninterrupted, bug-free, or that any particular content will be preserved.

11. Limitation of liability

To the maximum extent permitted by law, SEOGraphy, its operators, and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claim or demand arising out of your content, your use of the Service, or your violation of these Terms.

13. Termination

You can close your account at any time. We may suspend or terminate accounts that violate these Terms, cause security or legal risk, or stay inactive for an extended period. After termination, we delete your content and personal data per our Privacy Policy.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be announced at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Apptimistic operates, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless a binding consumer-law rule applies to you.
